Terms of Service

1. Agreement

By signing up for CS-Claro ("the Service"), you ("Customer") agree to these Terms of Service. The Service is provided by the Operator (contact details below) and consists of a multi-tenant customer-support SaaS application accessible at cs-claro.com.

2. Subscription & billing

The Service is offered as a monthly subscription with plans starting at €99/month (Starter), €249/month (Pro), and €499/month (Scale), all excluding VAT, billed in advance via Stripe. After signup, the Customer receives a 7-day free trial. The Customer may cancel at any time via the in-app billing portal. No refunds are issued for partial months. VAT is added at the rate applicable to the Customer's jurisdiction.

3. Acceptable use

The Customer agrees not to use CS-Claro for sending spam, illegal content, harassment, or any communication that violates applicable laws. The Operator reserves the right to suspend accounts engaged in such activity without refund.

4. Data & privacy

Customer data (tickets, messages, customer emails) is stored on Cloudflare D1 in the EU region and processed by CS-Claro. See our Privacy Policyfor details. The Customer is the data controller for their end-customers' data; the Operator is a data processor under GDPR Article 28.

5. Service availability

The Service is provided on a best-effort basis. The Operator aims for 99% uptime but does not guarantee uninterrupted availability. Planned maintenance will be announced via email or in-app banner.

6. Liability

The Operator's total liability is limited to the amount paid by the Customer in the preceding three (3) months. The Operator is not liable for indirect, consequential, or lost-profit damages. Nothing in these Terms excludes liability that cannot be excluded under Dutch law.

7. Termination

The Customer may cancel at any time. The Operator may suspend or terminate accounts for breach of these Terms, with a 30-day notice except in cases of fraud or abuse. Upon termination, the Customer may export their data for 30 days, after which it is deleted.

8. Changes

The Operator may amend these Terms with 30 days' notice via email. Continued use after the notice period constitutes acceptance. Material changes will be highlighted.

9. Governing law

These Terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
